Attendees: 2 Linden Labs (1 also Mercurial) 3 Sun: Simon Phipps, Tiki Dare (TM lawyer), ... 4 Mozilla (Frank Hecker, David Boswell, Zak Greant, ...) Jeff Waugh (GNOME) David Ascher (Python) Allison Randal (Perl) Bradley Kuhn (SFLC/SFC) Ted Leung (OSAF) Mike Milinkovich (Eclipse) David Mandel (LinuxFund) Josh Berkus (PostgreSQL) Trademarks ========== TM issues: What happens when corporations open source things? Germany is generally the biggest issue: strict laws Can register once for entire EU: name of registry is CTM (ctm-online) - CTM doesn't contain any of the individual registries that predated it, need to pay a service to search for you Think about more than project name, also other associated terms Do we need a shared entity that handles this stuff? Trademark licensing: your friends are your enemies Trademark broker: you license nonexclusively to them, they license to everyone - Maybe only to nonprofits, maybe to for-profits You have to exert quality control. We could use a Creative Commons for TM licensing. - Design to handle 90% of cases, let people hire lawyers for the other 10% "None of that shit matters if the code doesn't work" SFLC: Case studies on how projects use trademark licensing - Do we need to custom-tailor for each project, or is CC-like good enough? Restrictive licenses can cause trouble in adoption and mindshare - Apache Derby has 3 names, because Sun and IBM have their own versions for reasons of business support and release timing. Same code! TM enforcement can be done very quick. - Can meet with a judge and get a website takedown order within 3 days, even if the defendant doesn't show up Fundraising =========== LinuxFund -- 3700 people with cards, $8-12K / month - New card with USBank starts July 25 - Is the market big enough for more of these, one per large project? Google Checkout - free till end of year - then, significantly better than PayPal (~2%) - member agreement unclear on whether you must sell merchandise - Brad Kuhn will email foundations list with update Stores - GoodStorm: they're local, talk to them and see if they will add CDs - Make a vendor list on the wiki Membership program - like FSF - $120/yr billed monthly on CC so $10/mo - Benefits - FSF card - member # (people want low numbers) - @member.fsf.org email (not like contributor, but @fsf) - associate members, not voting members: clarify bylaws, amend articles of incorporations - some trinket not available anywhere else Donor benefits - Member meetings to talk with project leadership - Discounts for conferences - Throw 'em a bone anywhere you can Corporate patronage program - Rate based on # of employees or % of revenue - Discounts based on developer contribution Grants - Tough, because agencies fund specific goals at specific times - Developers work on a project of interest, not follow trends of agencies
