Trademarks

TM issues: What happens when corporations open source things?

Germany is generally the biggest issue: strict laws
Can register once for entire EU: name of registry is CTM (ctm-online)
	- CTM doesn't contain any of the individual registries that predated it,
		need to pay a service to search for you

Think about more than project name, also other associated terms

Do we need a shared entity that handles this stuff?

Trademark licensing: your friends are your enemies

Trademark broker: you license nonexclusively to them, they license to everyone
	- Maybe only to nonprofits, maybe to for-profits

You have to exert quality control.

We could use a Creative Commons for TM licensing.
	- Design to handle 90% of cases, let people hire lawyers for the other 10%

SFLC: Case studies on how projects use trademark licensing
	- Do we need to custom-tailor for each project, or is CC-like good enough?

Restrictive licenses can cause trouble in adoption and mindshare
	- Apache Derby has 3 names, because Sun and IBM have their own versions
		for reasons of business support and release timing. Same code!

TM enforcement can be done very quick.
	- Can meet with a judge and get a website takedown order within 3 days,
		even if the defendant doesn't show up
